What’s The Birthday Rule In Medigap Policies? Virginia has become the latest state to implement a version of the “Birthday Rule,” a consumer-friendly regulation in Medigap policy renewal, according to Jae Oh, author of Maximize Your Medicare.
What the Birthday Rule Is: Allows Medigap policyholders a window (usually around their birthday) to switch to another plan of equal or lesser benefit without medical underwriting.
Virginia’s Version:
Adopted a modified rule, effective July 2025.
Consumers can switch policies within 60 days of their birthday, similar to Oregon and California rules.
